These Terms & Conditions are entered into by and between you and The Early Years Collective, LLC.

By enrolling in, purchasing, or accessing any course, coaching session, digital product, or service provided by The Early Years Collective, LLC, you agree to the following Terms & Conditions.

1. Nature of Services (Educational & Coaching-Based)

All programs, courses, coaching sessions, materials, videos, downloads, and resources are educational and coaching-based in nature.

They do not constitute:

  • Feeding therapy

  • Occupational therapy services

  • Speech-language therapy

  • Medical or nutritional treatment

  • Mental health services

  • Clinical assessment

  • Diagnosis or prescriptive services

Participation in this program does not establish a therapist–client, clinician–patient, or medical provider relationship.

All information provided is general educational guidance intended to support caregiver understanding and informed decision-making.

2. Not Medical or Clinical Advice

The content provided is not a substitute for medical advice, diagnosis, or treatment.

You agree to consult a qualified healthcare professional regarding concerns related to:

  • Growth or weight changes

  • Nutritional adequacy

  • Swallowing safety

  • Medical or developmental diagnoses

  • Developmental regression

You agree not to disregard or delay seeking professional medical advice because of information obtained through this program.

3. Scope of Coaching Services

Coaching sessions:

  • Are parent-focused and educational

  • Provide reflection, guidance, and implementation support

  • Do not include clinical assessment or intervention

  • Do not include diagnosis or treatment planning

  • Do not involve direct therapeutic services

Coaching may discuss patterns that suggest additional support may be beneficial; however, this does not constitute diagnosis.

4. Participant Responsibility

You acknowledge and agree that:

  • Feeding progress varies widely among children

  • No specific outcomes or timelines are guaranteed

  • Results depend on factors beyond the Company’s control

  • You are solely responsible for decisions regarding your child’s care

You assume full responsibility for how you interpret and apply the information provided.

5. Red Flags & Referrals

This program may discuss feeding red flags or patterns that warrant further evaluation.

You understand that:

  • Identification of red flags is not a diagnosis

  • You are responsible for pursuing referrals or evaluations

  • The Company is not responsible for outcomes related to delayed, declined, or discontinued medical or therapeutic care

6. Eligibility

Services are intended for:

  • Adults age 18 or older

  • Parents, guardians, or legal caregivers

By enrolling, you confirm you are legally authorized to make decisions on behalf of the child discussed.

7. Intellectual Property

All materials provided by The Early Years Collective, LLC are protected intellectual property.

This includes but is not limited to:

  • Videos

  • Scripts

  • Worksheets

  • Handouts

  • Course structure

  • Coaching materials

You may not:

  • Copy, reproduce, or distribute materials

  • Share login credentials

  • Record or redistribute coaching sessions

  • Use materials for commercial, professional, or training purposes

  • Create derivative works

Unauthorized use may result in termination of access and legal action.

8. Payments, Access & Refund Policy

Course Access

Access is granted upon purchase and is for personal, non-commercial use only.

Coaching Sessions

Coaching sessions must be scheduled within the timeframe stated at purchase.
Missed sessions without required notice may be forfeited.

Refund Policy

Due to the digital nature of this program and immediate access to materials:

All sales are final once access is granted.

No refunds are provided unless otherwise stated in writing.

9. Confidentiality & Privacy

Information shared during coaching sessions is treated with respect and discretion.

However:

  • Services are not subject to HIPAA regulations

  • Absolute confidentiality cannot be guaranteed in digital environments

  • Disclosure may occur if required by law (e.g., suspected abuse, neglect, or imminent risk of harm)

Clients may not record coaching sessions without written permission.

10. Limitation of Liability

To the fullest extent permitted by law:

The Early Years Collective, LLC shall not be liable for:

  • Direct or indirect damages

  • Feeding-related outcomes

  • Health or developmental outcomes

  • Decisions made based on educational content

  • Financial or personal losses resulting from participation

Participation is voluntary and undertaken at your own risk.

11. Indemnification

You agree to indemnify and hold harmless The Early Years Collective, LLC from any claims, liabilities, damages, losses, or expenses arising from your participation in this program or decisions made regarding your child’s care.

12. Governing Law

These Terms & Conditions are governed by the laws of the State of Iowa, without regard to conflict-of-law principles.

13. Modifications

The Company reserves the right to update these Terms & Conditions at any time. Continued participation constitutes acceptance of any updates.
